A Starbucks barista made a mistake that “put his life in danger,” an Arkansas man claims. He’s filing a lawsuit

An Arkansas man is suing Starbucks after a “life-threatening” error with his order sent him to the emergency room, according to a recently filed lawsuit.

On Sept. 12, the Little Rock man ordered two drinks at a local Starbucks location, including an Apple Walnut Oat Frappuccino. He began drinking the Frappuccino and quickly realized something was wrong when he got home, according to the lawsuit filed April 5.

The drink’s maker used milk instead of oat milk, causing the man to go into anaphylactic shock, a potentially life-threatening allergic reaction, according to the lawsuit.

He was in “difficulty breathing” and injected himself with an EpiPen and called 911, according to the documents.

“EMS reported that he was hypotensive, strident and hypoxic,” the lawsuit said, meaning his blood pressure had dropped significantly, his airway was restricted and he had very little oxygen in his blood. “He was diagnosed with anaphylaxis in the emergency room.”

“Plaintiff has a severe allergy to milk,” the suit states. “This negligent error puts the life of a person with severe allergies at risk.”

McClatchy News reached out to Starbucks for comment but did not immediately receive a response.

The suit accuses Starbucks of “negligent and careless acts” and seeks damages, as the man “has endured pain and suffering in the past and will experience pain and suffering in the future,” as well as medical fees and lost wages.
