The Delhi High Court on Monday said there were “too many errors” in the AAP leader’s decision Somnath Bharti’s statement challenging BJP MP Bansuri Swaraj’s Lok Sabha election victory from the New Delhi constituency. The court asked Bharti to correct the errors and adjourned the case.
The AAP leader, in his statement, alleged corrupt practices in the elections in which Swaraj defeated him.
“It is full of errors. There are too many mistakes. Correct the petition,” said a member of the bench of Justice Manmeet Pritam Singh Arora, who decided not to issue a notice for now.
“I cannot issue a notice like this. I will simply adjourn it. Please file a corrected petition,” the court said.
The High Court noted that the references to the defendants made in the complaint do not correlate with the defendants in the memorandum of the parties. Furthermore, while the synopsis refers to a defendant, he has not been mentioned in the memorandum of the parties.
The petition was filed by Bharti under the provisions of the Representation of the People Act, alleging the use of corrupt practices by Swaraj. She also alleged that former AAP minister Raj Kumar Anand contested the elections on a Bahujan Samaj Party ticket to help Swaraj by reducing the vote share. Later, he joined the BJP, the petition said.
